Impact of EEOC Regulations on Wellness Programs

Many companies offer wellness programs to help employees live healthier lives. Given the host of laws that can apply to wellness programs, remaining in compliance should be a priority for all employers. In addition, there still exists a great deal of legal uncertainty with respect to the application of both GINA and the ADA to programs. This session will provide insights and recommendations to consider when designing wellness programs.
Topics to be discussed include:
- HIPAA’s nondiscrimination rules, as codified by the ACA
- Basics of wellness programs: participation-based, health-contingent, reasonable alternative standard and DOL focus for audits
- ADA: the EEOC proposed regulations and use of Health Risk Assessments, biometric screening and spousal incentives
- Impact of the Genetic Information Nondiscrimination Act (GINA).
